Welcome to Magic Roofing and Construction Co. Inc. These Terms and Conditions govern your use of our services, website, and any agreements for roofing services provided by Magic Roofing. By engaging with our company, you agree to the terms outlined below.

Magic Roofing provides commercial and residential roofing services, including but not limited to:

• Roof installation, replacement, and repairs
• Steep slope and low slope roofing solutions
• Metal roofing installations
• Seamless and commercial-grade gutter systems
• Emergency roofing services
• Storm damage inspections and insurance claim assistance
• Siding
• Framing
• General construction

3. Estimates and Pricing

• Estimates provided by Magic Roofing are free of charge and valid for 30 days unless otherwise stated.
• Pricing is based on materials, labor, and project complexity. Any changes made by the Client after signing the contract may result in additional charges.
• Magic Roofing reserves the right to adjust pricing due to material cost fluctuations or unforeseen conditions discovered during the project.

4. Payment Terms

• A deposit may be required before the commencement of work.
• Payment is due upon completion of the project unless otherwise specified in the contract.
• Late payments are subject to a 3% late fee per month on the outstanding balance.
• Accepted payment methods include cash, check, and major credit cards. Financing options may be available.

5. Project Scheduling and Delays

• Project timelines will be outlined in the contract and are subject to change based on weather conditions, material availability, and unforeseen circumstances.
• Magic Roofing is not responsible for delays caused by third-party suppliers, natural disasters, or other circumstances beyond our control.
• The Client will be notified of any changes to the project schedule as soon as possible.

6. Permits and Compliance

• Magic Roofing will obtain any necessary permits unless otherwise agreed upon.
• The Client is responsible for ensuring compliance with Homeowners’ Association (HOA) guidelines, if applicable.

8. Insurance and Liability

• Magic Roofing is fully licensed and insured for operations in New Mexico and the Four Corners region.
• Clients must notify Magic Roofing before work begins if their property is insured for roofing claims.
• Magic Roofing is not responsible for pre-existing damage or interior damages caused by leaks that existed prior to service.

9. Termination of Services

• Either party may terminate the contract with written notice.
• If the Client cancels after work has begun, they are responsible for costs incurred, including labor and materials.
• Magic Roofing reserves the right to cancel a project due to safety concerns, non-payment, or uncooperative site conditions.

10. Limitation of Liability

Magic Roofing is not liable for:

• Indirect, incidental, or consequential damages resulting from delays or project changes.
• Damage caused by existing structural deficiencies, mold, or rot within the Client’s roof or home.
• Property damage unrelated to roofing work, including landscaping or personal belongings.

11. Dispute Resolution

• Any disputes shall first be attempted to be resolved through negotiation between the Client and Magic Roofing.
• If a resolution cannot be reached, disputes will be subject to binding arbitration under the laws of New Mexico.

12. Changes to Terms and Conditions

Magic Roofing reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website and effective immediately upon posting.
